The Ministry of Defense demands from the contractor to pay 456 million UAH through court: they had to supply products and violated the conditions

The Defense Ministry is trying to recover 430m hryvnias it paid to a food supplier and 26.6m hryvnias in penalties through the court. In March 2022, the company was paid for the supply of products but they violated the terms of the contract.

In the press release itself, the Ministry of Defense does not name the enterprise in question. However, they specify the number of the case, which is No. 910/13416/22. According to the register of court decisions, it is a lawsuit against Thanos Technology.

"The company has repeatedly violated the terms of the contract, as a result of which the Ministry of Defense of Ukraine filed a lawsuit against the company for recovery of prepayment and penalties totaling UAH 456.660 million in December 2022 (430 million is the amount of the contract, 26.660 million is a penalty)," the company noted.

According to the YouControl information and analytics platform, the company belongs to the business group of Herman Nazarenko. Interestingly, the firm was registered less than 2 years ago and performs 37 different types of activities, the main of which is car and light motor vehicle trade. None of them are related to the MIC. The company's contact number is the same as 10 other legal entities. The company officially changed its head at the end of June, but it was headed by Mykola Petrenko at the time of signing the contract with the Ministry of Defense.

In February 2023, the Prosecutor's General Office was involved in the case by the ruling of the Economic Court of Kyiv. The proceedings of the case № 910/13416/22 were opened by order of the Economic Court in Kyiv on 09.01.2023, with the application of the Ministry of Defense of Ukraine being satisfied and the accounts of the defendant within the amount of lawsuit claims seized.

"On September 1, as a result of well-coordinated work of the legal service of the Ministry of Defense of Ukraine and the Prosecutor;s General Office, the decision of the Commercial Court of Kyiv satisfied the claims and the additional agreement was declared invalid. On September 6, the Defense Ministry's claim against the company under the main contract will be considered," the Defense Ministry said.

As reported by OBOZREVATEL, according to the Anti-Corruption Center, the daughter of one of the owners of the EDIUHET, which won the tender from the Ministry, bought luxury real estate in the center of Kyiv for 300 thousand dollars. The wife of the owner of the company probably has a Russian passport.
