New evidence has emerged implicating Gennadiy Bogolyubov in attempts to take over the "Boryvazh" port and inflict damages on PrivatBank amounting to UAH 5 billion

As previously reported, Gennadiy Bogolyubov and associated parties have been attempting to remove one of the country's largest grain terminals from PrivatBank's collateral through a scheme involving a fictitious mortgage and subsequent bankruptcy of the port's owner, LLC "Agroterminal Logistic."

To recap, LLC "Boryvazh" received loans from PrivatBank before its nationalization, with the current debt totaling UAH 5 billion. The port, which previously belonged to LLC "Boryvazh," was contributed to the authorized capital of LLC "Agroterminal Logistic." The corporate rights of LLC "Agroterminal Logistic," amounting to 99.9% of the authorized capital, were transferred to secure PrivatBank's loans, guaranteeing their repayment.

However, things did not go as planned. Following a sudden change in the management of LLC "Boryvazh" and LLC "Agroterminal Logistic," the real estate of the "Boryvazh" port was mortgaged to LLC "Terminal Boryvazh" to secure the repayment of financial assistance amounting to UAH 155 million, with a repayment deadline of March 31, 2025. After the mortgage agreement was signed, LLC "Terminal Boryvazh" and LLC "Agroterminal Logistic" entered into an additional agreement to the financial assistance contract, reducing the repayment period to August 14, 2024. It is evident that LLC "Agroterminal Logistic" and LLC "Terminal Boryvazh" intended to quickly sell the port's real estate through the mortgage agreement, thereby avoiding repaying the PrivatBank loan. However, PrivatBank managed to seize the port's real estate, and the plan failed. Consequently, LLC "Terminal Boryvazh" is now attempting to initiate bankruptcy proceedings against LLC "Agroterminal Logistic," having already filed two applications to the court, likely intending to select a "convenient" judge for this case.

LLC "Boryvazh" is controlled by Gennadiy Bogolyubov through a network of offshore companies, as previously documented by Obozrevatel.

It has been revealed that LLC "Terminal Boryvazh" was established in 2020 with an authorized capital of 10,000 UAH by Mr. O.V. Kuznetsov, and Mr. P.V. Naumenko was appointed as the director. Both of these individuals were employees of LLC "Boryvazh" until 2022, which belongs to Mr. Bogolyubov and his associated parties. This directly indicates the connection between these companies and that Bogolyubov controls both LLC "Agroterminal Logistic" (the port owner) and LLC "Terminal Boryvazh" (the mortgage holder and initiator of the port's bankruptcy). It is clear that he is doing everything possible to remove the port from the bank's collateral.
