Is it possible to appeal against a fine of the transfer pricing company from abroad: a detailed explanation
Citizens of Ukraine liable for military service must comply with the rules of military registration, even if they are abroad. In case of violation of the law, a fine of 17 to 25 thousand hryvnias may be imposed.
However, even from abroad, fines from the MCC and JV can be appealed. This was stated by lawyer Dmytro Franchuk.
According to him, non-payment of the fine may result in a penalty for each day. In addition, territorial recruitment centers may apply to the executive service to open proceedings to enforce the fine or even seize the violator's property.
At the same time, the lawyer stated that appealing a fine for persons outside Ukraine is a difficult but possible process. To appeal a fine, you need to start the procedure immediately, as you have only 10 days to do so.
The lawyer recommends providing documents that would confirm the person's stay abroad, as this can be a strong argument when appealing the fine. However, it should be borne in mind that failure to appear at the MCC under a summons may result not only in an administrative fine, but also in criminal liability for evading mobilization. Therefore, if you receive a call while abroad, it is very important to take steps to resolve the situation.
In order to appeal the fine, you need to issue a power of attorney to represent your interests in Ukraine. Such a document must be certified by a notary at the consular office of Ukraine in the country where the offender is located.
You should also file an application for appealing the fine from the MCC that issued it. The application should include the personal data of the person subject to the fine; details of the decision to impose the fine (number, date); reasons why you consider the fine to be illegal; evidence supporting your arguments (copies of documents on staying abroad, power of attorney).
If the decision of the МCC to appeal the fine is negative, you can appeal it in court. A claim can also be filed with the court by a representative under a power of attorney, and the period for appealing the decision of the TCC in court lasts 10 days from the date of receipt of the decision.
As reported by OBOZ.UA:
– a man who has three dependent children, one of whom is of age, is not entitled to a postponement of the call-up for military service during mobilization. This right is granted only if there are three or more children under the age of 18.
– At the same time, parents with many children may lose the right to a deferment under certain circumstances. To apply for a deferment, a request must be submitted to the MCC.
– The government has allowed a new category of citizens – clergy – to be exempted from mobilization. In total, up to 50% of representatives of religious organizations can be exempted. At the same time, priests are not subject to the requirement of a minimum salary of 20 thousand hryvnias.
