Hennadiy Boholyubov initiates court case over Borivazh port's "bankruptcy": the judge has already been changed

As previously reported, Hennadiy Boholyubov tried to bail out the port of Borivazh using dubious schemes with fictitious transactions. Recently, the port was mortgaged to Terminal Borivazh LLC and then arrested by the court. At this stage, PrivatBank managed to fend off Boholyubov's intervention.

However, the confrontation did not end there. Using artificially created debts, Terminal Borivazh LLC is trying its best to establish control over Agroterminal Logistic LLC (the owner of the port) by initiating bankruptcy proceedings. It is reported that on 21.08.24, Terminal Borivazh LLC filed a petition with the Commercial Court of Dnipropetrovsk Oblast to initiate bankruptcy proceedings against Agroterminal Logistic LLC.

According to available information, the case was assigned to Judge Y. Pervushyn (Case No. 904/3717/24). On the same day, Terminal Borivazh LLC withdrew its application either because it changed its mind about initiating the case or did not like the judge for some reason. Judge Pervushyn returned the withdrawn application on August 22, 24. Just an hour later, Terminal Borivazh LLC filed the same application with the court, which was now assigned to Judge A. Sukhovarov (Case No. 904/3747/24). Importantly, both applications were signed by the same lawyer, Kyrylo Ryabokin.

In legal jargon, such actions are called a "carousel" and are usually done to select a judge loyal to the applicant, but the law gives a clearer definition of this - abuse of procedural rights, which has certain consequences (including criminal ones). The coming days will show whether Privatbank will be able to repel another Boholyubov's attack.
