The case of seizure of the port of Borivage: Dynasty's lawyers suspected of facilitating Bogolyubov's scheme

Lawyers of Dynasty Law Firm LLC may be involved in the case of illegal seizure of the Borivage port in Odesa region. The scandal surrounding the "seizure" of the port with possible losses of UAH 5 billion for PrivatBank was unofficially linked to businessman Gennadiy Boholyubov. It is likely that the lawyers could have acted in his interests.

Thus, the lawyers are involved in criminal proceedings No. 42023000000001625 of 02.10.2023. It concerns the illegal dissemination of information by employees of a number of courts of various instances of the Dnipro region and lawyers.

The port of Borivage belongs to Agroterminal Logistic LLC. The terminal was pledged to PrivatBank as collateral for billions of dollars in loans. The media accused Boholyubov of using legal and financial schemes to seize the port, which threatened the state bank with losses of more than UAH 5 billion.

Dynasty's lawyers may be connected to the implementation of this scheme. In particular, it is likely that the lawyers could have contributed to the change of management of Borivage LLC and Agroterminal Logistic LLC in the state register without proper authority.

Such schemes are usually carried out through "black notaries," and this case is hardly an exception. Even before his resignation, former Minister of Justice Denys Malyuska managed to sign a decree to uphold the complaint against the notary who performed the registration actions against Borivage LLC and Agroterminal Logistic LLC.

According to the decision of the Kyiv Commercial Court of 06.09.2024 on acceptance of the application for opening bankruptcy proceedings (No. 910/10955/2), lawyers filed bankruptcy petitions against the company that owns the port on the basis of allegedly unpaid debts for legal services. The document referred to the amount of UAH 300 thousand.

"Dynasty Law Firm's Personal Service Office filed a petition with the court to initiate bankruptcy proceedings against Agroterminal Logistic LLC... in connection with existing and outstanding debts," the document says.

The documents may also indicate that the law firm has the ability to use judicial manipulation by changing the place of registration of companies to choose a "convenient" jurisdiction. In particular, the place of registration allows initiating bankruptcy proceedings against the port in the economic court of Dnipropetrovs'k region.

Earlier, the judge in the port's bankruptcy case was replaced. This raises additional suspicions, as the facts published in the media may indicate a large-scale and planned operation aimed at complicating PrivatBank's attempts to repay its multibillion-dollar debt. These facts could be verified by the Security Service of Ukraine (SBU), whose reaction is expected by the public.
