In 2023, Oleh Kiper, the head of the Odesa RMA and former head of the Kyiv City Prosecutor's Office, sued the Main Department of the Pension Fund of Ukraine in Chernivtsi Region to have his seniority recalculated and receive a pension for his years of service as a prosecutor. The administrative claim was partially satisfied, but it was enough for the court to recognize Kiper as an official "pensioner."

The decision was made by the judge of the Kyiv District Administrative Court Lysenko Viktoriia Ivanivna. The relevant materials were published in the Unified Register of Pre-trial Investigations.

The name of the plaintiff is not disclosed in the text, but since he submitted full information about his official work and positions for the trial, it is easy to establish that it is Oleh Kiper.

The proceedings were opened on April 12, 2023. Kiper was the prosecutor of the capital from September 2020 to May 2023, so the court decision states that the plaintiff "continues to work in the prosecution authorities of Ukraine as the head of the Kyiv City Prosecutor's Office."

Kiper filed the lawsuit after the Pension Fund's Chernivtsi Regional Department denied him a pension on February 13, 2023. The then-prosecutor wanted this decision to be canceled, and the following periods of study at the Odesa Law Academy to be included in his insurance record and seniority:

– from September 01, 1997 to June 27, 2001;

– from September 01, 2001 to June 22, 2002;

– from October 1, 2016 to March 30, 2018.

It should be noted that to receive this type of pension, Kiper was required to accumulate the length of service provided for in part 6 of Article 86 of the Law of Ukraine "On the Prosecutor's Office" of 14.10.2014 (25 years, including at least 15 years as prosecutors).

The amount of such pension is 60% of their monthly (effective) salary, which includes all types of remuneration from which a single contribution to the obligatory state social insurance was paid.

The Pension Fund (PF) explained the refusal by the fact that the official did not have enough seniority – he was credited with only 23 years, 3 months, and 14 days (instead of the required 25 years). At the same time, Kiper had worked as a prosecutor for 21 years, 3 months, and 22 days, the PF recognized.

The court solved this problem and added to the length of service the periods of study at the full-time department of the law school from September 1, 1997, to June 27, 2001 (+3 years 9 months 27 days) and from September 1, 2001, to October 15, 2001 (+1 month 15 days ). In other words, some periods of study were not credited, but this was enough to increase the plaintiff's seniority to 25 years, 3 months, and 3 days.

In this regard, on August 7, 2023, the Kyiv District Administrative Court ordered the Main Department of the Pension Fund of Ukraine in the Chernivtsi Region to grant Kiper a long-service pension from February 06, 2023, following Article 86 of the Law "On the Prosecutor's Office."

Earlier, the National Agency for the Prevention of Corruption classified Oleh Kiper's declarations for 2021, 2022, and 2023 due to mobilization.
