Can you install a water heater in an apartment and a house: explanation

After enduring the extremely challenging winter of 2022-2023, Ukrainians are already preparing for the next one, considering the risk of blackouts and heating outages. Given the unpredictable behavior of neighbors like the Russians, a new wave of attacks on energy infrastructure during the cold season is a potential threat. That's why one of the most sought-after products now is a stove.

The indoor metal stove operates on solid fuel and is independent of both electricity and gas. However, it can only be installed in a very limited list of buildings and premises. OBOZREVATEL has explored where you can put a stove where it is illegal to do so, and what punishment you might face.

Apartment in a high-rise building

The law prohibits the installation of stoves in apartment buildings, with no exceptions due to the associated danger. The ventilation system in such buildings is not designed to handle large amounts of carbon monoxide, and a stove emits a significant amount of it. Even if the stove's chimney is directed out the window, it can still contaminate the room's atmosphere.

Another danger is the heating of the floor beneath the stove. The hot metal or an accidental spark can cause a fire in the apartment, posing an unreasonably high risk, as experts emphasize.

Penalty for installing a water heater in an apartment

Installing such a stove in an apartment building contradicts Article 270 of the Criminal Code, "Violation of fire or industrial safety requirements established by law." In most cases, this results in administrative liability, but in some instances, criminal liability may apply. In the former case, the violator can face a fine ranging from 1000 to 4020 tax-free minimums (from 17 to more than 68 thousand hryvnias) or be sentenced to correctional labor for up to two years or restriction/imprisonment for up to 3 years. If the installation of a stove in an apartment causes a fire with a loss of life, significant material damage, or other serious consequences, the perpetrator may face imprisonment for a term of 3 to 8 years.

Private house or garage

Unlike city apartments, you can install stoves in private homes or garages. However, it's crucial to choose the right type of stove and the optimal location, considering the chimney's placement to remove air with smoke and carbon monoxide.

The stove should ideally be installed on a concrete, brick, or other fire-resistant floor, avoiding linoleum. If removing a part of the flooring for the stove, ensure the material's edge starts no closer than 50 cm from the stove.

Maintain a safe distance between the stove and walls or furniture. A shorter distance increases the risk of fire.

Position the stove so that it doesn't obstruct movement around the house, considering its high operating temperature, which can cause burns if accidentally touched.
